  • We are a member of the Banking Technology Forum (Forum Technologii Bankowych) at the Polish Bank Association.
  • We are a member of the Polish Organization of Non-Bank Payment Institutions (Polska Organizacja Niebankowych Instytucji Płatności).
  • We have the status of a national payment institution supervised by the Polish Financial Supervision Authority.
  • Since 2011, following the approval of the National Bank of Poland, we have been conducting billing and settlement operations under the name BlueCash Payment System, subject to the supervision of the NBP.
  • We have a PCI DSS certificate that allows us to process card data in IT systems and payment gateways.

Corporate governance

Based on the resolutions of the Management Board and the Supervisory Board of the Company, Autopay S.A. has implemented and applied, since January 1, 2015, the “Principles of Corporate Governance for Supervised Institutions” (Zasady ładu korporacyjnego dla instytucji nadzorowanych) set out by the Polish Financial Supervision Authority (KNF) in a document available on the websites of the Polish Financial Supervision Authority.

At the same time, Autopay S.A. informs that the Supervisory Board of the Company, at the request of the Management Board, accepted the waiver of the application of the principle specified in §21 sec. 2 sentence 2 of the “Principles of Corporate Governance for Supervised Institutions” (Zasady ładu korporacyjnego dla instytucji nadzorowanych) regarding the election of the chairman of the supervisory body with consideration to the criterion of independence.

Pursuant to §27 of the “Principles of Corporate Governance for Supervised Institutions” (Zasady ładu korporacyjnego dla instytucji nadzorowanych), the Supervisory Board of Autopay S.A. evaluated, on March 02, 2020, the application of the Corporate Governance Principles implemented in the Company in 2019, and positively assessed the functioning of these principles within the Company, including the appointment of an independent internal audit function in place of the audit unit in the Compliance Department.

Personal information

We process personal information in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Detailed rules for the processing of personal information are set out in the Autopay S.A. Privacy Policy.

Handling of complaints

Each customer has the right to file a complaint, an application or a complaint regarding the services or activities of Autpay S.A. The application or complaint can be submitted:

  • in writing – in person at the Company’s premises or through a postal operator, courier, or messenger to the Company’s address: ul. Powstańców Warszawy 6, 81-718 Sopot;
  • electronically – through the complaint form available at: pomoc.autopay.eu
  • orally – by calling 58 7604 844 from 7:00 a.m. to 10:00 p.m. on weekdays and from 8:00 a.m. to 4:00 p.m. on Saturdays, or in person at the Company’s premises (on weekdays from 8:00 a.m. to 4:00 p.m.), on record.

If the company does not accept the claims arising from the complaint regarding financial services, the customer has the right to apply for the case to be examined by the Financial Ombudsman (https://rf.gov.pl). The Financial Ombudsman is an entity authorized to settle out-of-court consumer disputes, as well as the disputes between entrepreneurs regarding the provision of financial services.

Disputes arising from the provision of payment services at the Customer's request may also be resolved by the Arbitration Court at the Polish Financial Supervision Authorityhttps://www.knf.gov.pl -> Sąd Polubowny (Arbitration Court) tab).

Additional information

  1. Autopay S.A., by the decision of the Polish Financial Supervision Authority of October 1, 2013, obtained a permit to provide payment services as a national payment institution and was entered into the register of payment service providers under the number: IP17/2013.
  2. Autopay S.A., by the decision of the President of the National Bank of Poland No. 2/2011 of November 25, 2011, obtained a permit to operate a payment system called “BlueCash Payment System” (System płatności BlueCash).   3. On October 27, 2014, Autopay S.A. obtained a certificate of compliance with the PCI DSS (Payment Card Industry Data Security Standard) issued by SC2labs Sp. z o. o., confirming that the company complies with the requirements ensuring data security in regard to the transactions handled by the company with the use of payment cards.
  4. Autopay S.A. is a telecommunications company registered in the Register of Telecommunications Undertakings (Rejestr przedsiębiorców telekomunikacyjnych), kept by the President of the Office for Electronic Communications, under the number 11050.

The management boards of Autopay S.A. with its registered seat in Sopot and Autopay Mobility Sp. z o. o. with its registered seat in Warsaw, acting pursuant to Art. 533 § 1 and § 3 and Art. 533 § 3 of the Code of Commercial Companies (Kodeks Spółek Handlowych), established, on June 30, 2020, a division plan for Autopay S.A. with its registered seat in Sopot, executed pursuant to Art. 529 § 1 point 4, i.e. through transferring some of the assets of Autopay S.A. to Autopay Mobility sp. z o.o.

The Division will be carried out in accordance with Art. 542 § 4 of the Code of Commercial Companies, using the equity of the Divided Company different than the share capital, i.e. without reducing the share capital of the Divided Company since the Divided Company has sufficient reserve capital. The shareholders of the Divided Company may review the documents listed in Art. 540 § 1 of the Code of Commercial Companies at the company’s premises and on the website by the date of adopting the resolution on the division.
